1 OFFICECHEFS respects your privacy

1.1 The protection of your privacy when processing personal data, as well as the security of all business data, is an important matter for us, which we take into consideration in our business processes. We process personal data collected when using the OFFICECHEFS application confidentially and only in accordance with legal requirements.

3 Collection, processing and use of personal data

3.1 Processed data categories

The following categories of data will be processed:

 

  • Communication data (e.g. name, telephone, e-mail address, address via payment provider).

 

  • Contract data (e.g. contractual relationship, product - or contractual interest)

 

  • Customer history

 

  • Contract billing and payment data

 

  • Location data

 

3.2 Personal data are all information relating to an identified or identifiable natural person, such as names, addresses, telephone numbers, e-mail addresses, contract, booking and billing data, which are an expression of the identity of a person. We collect, process and use personal data (including IP addresses) only if there is a legal basis for doing so or if you have given us your consent in this regard, e.g. in the context of a registration.

 

 

 

 

 

4 Processing purposes and legal bases

 

4.1 We and service providers contracted by us process your personal data for the following processing purposes:

 

  • Registration of a user account: In order to use the services of OFFICECHEFS, a user account is required. (Legal basis: Contract fulfillment)

 

  • User profile: If and insofar you want to use services via OFFICECHEFS, we need your data in order to be able to issue invoices. (Legal basis: Contract fulfillment)

 

 

  • Allocation of coworking spaces: In order to display coworking spaces in your area, we need your location data (GPS). You can define yourself in the system settings of your cell phone whether location data may be used by the OFFICECHEFS application. If you do not allow the use of location data in the system settings of your cell phone for the OFFICECHEFS application, we will be able to show you coworking spaces, but they may not be located in your area.   • Payment processing: You can select a payment service provider for the payment of meals or events that take place via the OFFICECHEFS application. In this context, we receive from the payment service providers your name, email address and other information necessary for payment control. (Legal basis: Contract fulfillment)

 

  • Ordering meals/booking events: When ordering meals or booking an event, we collect your data in order to transmit them to user-seller and organizer of the event. (Legal basis: Contract fulfillment)

 

  • Post offers: By offering meals or events, we collect your data to display them within the OFFICECHEFS application for users. (Legal basis: Contract fulfillment)

 

  • Create favorites: You can mark preferred coworking spaces to find them later quickly and easily in a favorites list. We save the corresponding coworking spaces in your user profile. You can remove favorites at any time. (Legal basis: Contract fulfillment)

 

  • Communication within the application: In the context of communication with other users, coworking spaces, trainers, organizers or OFFICECHEFS itself, we collect your data, e.g. to track inadmissible content within these chats. (Legal basis: Contract fulfillment)

 

  • Support: As part of our user support, we collect your data to help you solve your problem. This includes logging your activities within the OFFICECHEFS application. (Legal basis: Contract fulfillment)

 

  • Rating of meals and events: You can rate individual meals and events in the OFFICECHEFS application, e.g. according to quality and price. These ratings are then published in the OFFICECHEFS application. (Legal basis: Legitimate interest in improving our service quality).

 

4.2 Duration of storage; retention periods:

We generally store your data for as long as it is required to provide our services within the scope of your use of the OFFICECHEFS application and the associated services or we have a legitimate interest in continuing to store it (e.g., we may still have a legitimate interest in postal marketing even after a contract has been fulfilled). In all other cases, we delete your personal data with the exception of data that we must continue to store in order to fulfill legal obligations (e.g., we are required to retain documents such as contracts and invoices for a certain period of time due to retention periods under tax and commercial law).

 

5 Data disclosure

5.1 Transfer of data to other responsible parties

As a matter of principle, we will only transfer your personal data to other responsible parties if this is necessary for the performance of the contract, if we or the third party have a legitimate interest in the transfer, or if we have your consent for this purpose. Details on the legal grounds can be found in the section Processing purposes and legal grounds. If data is transferred to third parties on the basis of a legitimate interest, this is explained in this data protection notice. In addition, data may be transferred to other responsible parties if we are required by law or by enforceable official or court order to do so.

 

5.2 Service providers (general)

We commission external service providers with tasks such as payment processing. We have carefully selected these service providers and monitor them regularly, in particular their careful handling and safeguarding of the data stored with them. All service providers are obligated by us to maintain confidentiality and to comply with legal requirements.

 

5.3 Payment service providers

We use external payment service providers. Depending on which payment method you select in the ordering process, we pass on the data collected for the processing of payments (e.g. bank details or credit card data) to the credit institution commissioned with the payment or to payment service providers commissioned by us. In some cases, the payment service providers also collect and process this data as responsible parties. In this respect, the data protection information of the respective payment service provider applies.

 

6 Data transmission by app store operators

No data collection on our part and outside our area of responsibility is the transmission of data such as user name, e-mail address and individual device identification number to the app store when downloading the OFFICECHEFS application. We have no influence on this data collection and further processing by the app store as the responsible party.

 

7 Use of External Links

The OFFICECHEFS application may contain links to third-party websites - providers not affiliated with us. After clicking on the link, we no longer have any influence on the collection, processing and use of any personal data transmitted to the third party when the link is clicked on (such as the IP address or the URL of the page on which the link is located), as the behavior of third parties is naturally beyond our control. OFFICECHEFS assumes no responsibility for the processing of such personal data by third parties.

 

 

 

8 Security

8.1 Our employees and the service companies contracted by us are obliged to maintain confidentiality and to comply with the provisions of the applicable data protection laws.

 

8.2 We take all necessary technical and organizational measures to ensure an adequate level of protection and to protect your data managed by us in particular against the risks of accidental or unlawful destruction, manipulation, loss, alteration or unauthorized disclosure or access. Our security measures are constantly being improved in line with technological developments.

 

9 User rights

9.1 Your rights as a user are described in detail in this section. Please use the information in the Contact section to assert your rights. Please make sure that we are able to clearly identify you.

 

9.2 Right to information and disclosure: You have the right to receive information from us about the processing of your data. For this purpose, you can assert a right to information with regard to the personal information that we process from you.

 

9.3 Right to rectification and deletion: You may request us to correct incorrect data and - insofar as the legal requirements are met - to complete or delete your data. This does not apply to data that is required for billing and accounting purposes or is subject to the legal obligation to retain data. However, to the extent that access to such data is not required, its processing will be restricted (see below).

 

9.4 Restriction of processing: You may request us - insofar as the legal requirements are met - to restrict the processing of your data.

 

9.5 Objection to data processing: In addition, you have the right to object to data processing by us at any time. In this case, we will stop processing your data unless we can prove - in accordance with the legal requirements - compelling reasons for further processing that are worthy of protection and that outweigh your rights.

 

9.6 Objection to direct marketing: You may also object at any time to the processing of your personal data for advertising purposes ("advertising objection"). Please take into account that, for organizational reasons, there may be an overlap between your revocation and the use of your data in the context of an already ongoing campaign.

 

9.7 Objection to data processing on the legal basis of "legitimate interest": You also have the right to object to data processing by us at any time, insofar as this is based on the legal basis of legitimate interest. We will then stop processing your data unless we can prove - in accordance with the legal requirements - compelling reasons for further processing that are worthy of protection and which outweigh your rights.

9.9 Data portability: You continue to have the right to receive data that you have provided to us in a structured, common and machine-readable format or - if technically feasible - to request that the data be transferred to a third party.

 

9.10 Right of appeal to the supervisory authority: You have the right to file a complaint with a data protection authority. For this purpose, you can contact the data protection authority responsible for your place of residence.
